Copying

Can a small mattress maker legally copy the construction of a big brand's product?

I run a tiny mattress workshop and a customer asked if I can replicate the exact layer stack and coil setup of a popular big-brand hybrid. I'm not talking about using their name or logo, just the construction. Is that legal? I don't want to get sued into oblivion.

Construction itself generally isn't protected by copyright or trademark. Patents are the big one—if the brand has an active utility patent on the coil design or a specific layer arrangement, you could be in trouble. Otherwise you're probably fine.

Also trade dress. If your mattress looks confusingly similar in a way that makes people think it's theirs, that's a different probleem. But just copying the internals? Most of that is functional and not protectable.

lol every mattress is basically the same 3 or 4 materials stacked in different orders. good luck proving someone 'copied' foam over coils.

I'd still document your own design process and maybe have a lawyer glance at it. Because even if you win, defending a lawsuit can kill a small shop

Yeah, that's the real risk. Not the law, the legal bills.

Wait, are you reverse-engineering a specific big brand or just making a 'similar feel'? Because if the customer brings you a cut-open mattress and says 'clone this,' thats a lot more precarious than you designing a 3-zone hybrid from scratch.

This is going to sound dumb but isn't there like a mattress mafia that sends cease and desist letters for using the same coil count? I swear I read that somewhere.

ferrous_wheel

Coil count isn't protectable. You're thinking of patents on specific coil geometries or zoning patterns. And no, there's no mattress mafia. Probably.
